These Terms and Conditions – “Gold Rush by PhonePe” (“Terms”) govern your use of and access to the “Gold Rush” (“Game”). The Game is being offered by PhonePe Private Limited, a company incorporated under the Companies Act, 1956 with its registered office at Unit No. 001, Ground Floor, Boston House, Suren Road, Off. Andheri-Kurla Road, Andheri (East) Mumbai – 400 093, India (hereinafter referred to as "PhonePe").

By playing or accessing the Game you agree to these Terms. If you do not understand these Terms, or do not accept any part of them, then you should not use or access the Game. PhonePe reserves the right, at our sole discretion, to change, modify, add or remove portions of these Terms.

Subject to these Terms, PhonePe grants you a non-exclusive, non-transferrable, non-sublicensable, limited right to use the Game for your own personal, non-commercial, entertainment purposes. You agree not to use the Game for any other purpose and understand that you will not receive any reward (monetary or otherwise) by playing this game. The rights granted to you are subject to your full compliance with these Terms and applicable laws.

Except as set out in this clause, you do not receive any other license and PhonePe retains all right, title and interest in the Game. This means that PhonePe owns at all times all intellectual property including but not limited to copyright, trademarks, code, software, characters, themes, character names, game names, storylines, dialogue, settings, artwork, sounds effects, trade secrets, patents, titles, and any and all rights in, or derived from, the Game. The Game must not be copied, reproduced or distributed in any manner or any medium without PhonePe’s prior written consent, which will be granted or withheld at PhonePe’s sole discretion.

The licence ends on the earlier of your discontinuance of the use of/access to the Game or when terminates your licence in accordance with these Terms.

The Game may include certain virtual items such as badges or other reward titles which items can be earned through gameplay only (“Virtual Items”). You agree that Virtual Items only exist within the Game and can never be exchanged for real money, real goods or real services from PhonePe or anyone else. PhonePe reserves the right to control, regulate, change or remove any Virtual Items without notice and without any liability to you. You may be allowed to share the Virtual Items over social media and in such case, you are being provided a limited personal revocable non-transferable licence to share them on social media.

You are not entitled to bring any claims in respect of the Virtual Items. To the full extent permitted by law, PhonePe will not be liable to compensate you in respect of any matter whatsoever related to the Virtual Items, including but not limited to any loss you allege to have suffered or any claims you allege to be entitled to bring.

You must comply with any applicable third-party terms of agreement when using the Game.

You will not:

rent, lease, lend, sell, transfer, redistribute or sublicense the Game, or make the Game available over a network where it could be used by multiple devices at the same time.

use the Game for any commercial purpose without PhonePe’s prior written connect. Without limiting the foregoing you must not make the Game available for public use such as in a games arcade, use our Game within your own products or content such as in television programmes or films, use our Game in advertising, solicitation or transmission of any commercial advertisements in any way;

attempt to gain unauthorised access to the Game, make any automated use of the Game, post your personal data or another person’s personal information or data through the Game;

attempt to decompile, reverse engineer, disassemble or hack the Game, or to defeat or overcome any of the encryption technologies or security measures;

use the Game to harass, abuse, threaten or harm another person or to attempt to, or incite another, to harass, abuse or harm another person or group;

copy, distribute, make available to the public or create a derivative work from the Game or any part thereof;

use the Game to gather, accumulate or otherwise aggregate information or data; or
use the Game in connection with the actual or attempted contravention of any laws.

To use the Game, you must comply with the laws that apply to you in the location that you access the Game from. If any laws applicable to you restrict or prohibit you from using the Game, you must comply with those legal restrictions or, if applicable, stop accessing and using the Game.

PhonePe has the right to withdraw or modify the Game (in whole or in part) at any time for any reason. PhonePe reserves the right to limit, suspend, terminate, modify or deny you access to the Game if PhonePe suspects that you are failing to comply with any of these Terms, or using the Game for any actual or suspected illegal or improper use.

You agree to indemnify and hold PhonePe, its affiliates, employees, directors, officers, agents and representatives, harmless, from any and all losses, damages, actions, claims and liabilities (including legal costs) which may arise, directly or indirectly, from your access to or use of the Game (including these Terms), in any manner whatsoever.

THE GAME IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS FOR YOUR USE. YOU UNDERSTAND THAT THE GAME CANNOT BE GUARANTEED TO BE ERROR FREE AND THE EXISTENCE OF ANY ERRORS WILL NOT BE A BREACH OF THESE TERMS EXCEPT AS EXPRESSLY PROVIDED TO THE CONTRARY IN THESE TERMS. TO THE FULL EXTENT PERMITTED BY LAW, PHONEPE WILL NOT BE LIABLE TO YOU FOR ANY LOSS, INCLUDING SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES (SUCH AS LOSS OF PROFITS), OR CLAIM, ARISING OUT OF BREACH OF THESE TERMS. PHONEPE’S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY LOSSES YOU INCUR OR CLAIMS YOU MAKE AGAINST PHONEPE IS LIMITED TO A SUM OF INR 100.

You must take your own precautions to ensure your access to the Game does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your device. PhonePe does not accept responsibility for any interference or damage to your devices which arises in connection with your use of the Game.
