All digital learning resources found on the LearnAlberta.ca web site have been developed or licensed specifically for Alberta Education/LearnAlberta.ca. Canadian copyright law and international copyright treaties protect all these resources, which consist of a series of audience-specific web pages that facilitate access to a learning object collection that supports Alberta curriculum.

Third-Party Content

The LearnAlberta.ca portal contains third-party content that has been licensed to Alberta Education by third-party copyright holders. Some of that third-party content has been licensed specifically for the use of Authorized Users who qualify for a User ID and Password. Every effort has been made to identify all licensed material with a copyright symbol © or an appropriate credit located near the borrowed excerpt or in a copyright credit index attached to the resource. B. TERMS OF USE AGREEMENT

NOTICE TO END-USER: This Terms of Use Agreement (this "Agreement") is a complete and legal agreement between You and the Crown in Right of Alberta as represented by the Minister of Education (the "Minister") regarding the use of LearnAlberta.ca (the "Portal") and the content (the "Resources") found on the site. Any rights not specifically granted in this Agreement are reserved. By using the Portal, You accept the terms of this Agreement. If You do not agree with these terms and conditions, do not use this Portal and delete all associated files from your system.

DEFINITIONS:

  1. Authorized Users - "Authorized" users are currently enrolled students, their parents, and school staff of all publicly-funded, Kindergarten to Grade 12 schools in Alberta. This includes Public, Separate, Francophone, Charter, and publicly funded Private or Virtual schools. In addition, Alberta students in Education programs in universities and colleges and students working in upgrading programs within the K-12 context at colleges (for example in high school upgrading or college preparation programs) and faculty members, instructors and library staff associated with these programs are authorized to access the resources.

  2. Guest Users - "Guest" users are those who do not qualify for authorization to access protected content on the Portal.

TERMS AND CONDITIONS: Users should reference the copyright link on individual Resources found on the Portal for special conditions and/or restrictions that may be attached to the use of that particular Resource.

In return for the right to use the content accessed through the portal, You agree as follows:

  1. Scope of Use
    LearnAlberta.ca Resources are licensed, not sold, to You for use on single workstations at home or at school on a computer network in an Alberta school jurisdiction provided. You also reproduce and include the Copyright Statement and all other proprietary notices attached to the original.

    A "computer network" is any number of terminals electronically linked and capable of sharing the use of a single Resource. To "use" any Resource is to load included files in either the temporary (e.g., RAM) or permanent (e.g., hard disk, CD-ROM) memory of a computer.

  2. User Identification and Password
    A User Identification (ID) and Password are issued annually to those who qualify as Authorized Users. The UserID and Password enable Authorized Users to access content that has been licensed specifically for the use of school authority personnel, students, and their parents who are registered in publicly-funded, Kindergarten to Grade 12 schools in Alberta. UserIDs and Passwords may not be posted to a publicly accessible web site or distributed to anyone in any way who has not been authenticated by LearnAlberta.ca as an Authorized User. You are responsible for maintaining the confidentiality of your ID and Password.

  3. Permitted Uses
    The following permitted uses do not require written permission from Alberta Education. With respect to content owned by Alberta Education, You:

    Derivatives developed from Crown-owned content may also be reproduced for use within your school jurisdiction. Alberta Education is not responsible for such derivative works since they are not considered authorized resources of Alberta Education.

    Term: This Agreement is effective until terminated. This Agreement will terminate automatically, and without notice to You, if You fail to comply with any of its terms. Upon termination, You must destroy all copies of any Resources and related documentation obtained from this site. If You download and store or reproduce any copies of Resources found on this site, You agree to destroy or delete those copies once they no longer exist on the site or an expiry date for the Resource has passed or You cease to be an Authorized User in Alberta.

  7. Updates: The Minister reserves the right to provide updates to the Resource from time to time. Once an update is provided, You agree to destroy all prior copies and versions. Only then does this license transfer to the updated Resource.

  8. Warranty: The Minister makes no warranties - express or implied - arising from your use of the Resource and the Minister expressly excludes any and all warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party rights.

  9. Limit of liability and hold harmless: Under no circumstances will the Minister be liable to You for any consequential or incidental damages arising from your use of the Resource, including lost profits or lost savings, or for any claim by any party. You agree to hold harmless the Minister from any and all third-party claims, demands, or actions for which You are legally responsible, including those arising out of negligence or willful acts by You or by others under your control.

  10. Governing Law: The laws of the Province of Alberta shall govern this Agreement.

Minor Modifications

Minor modifications are allowed without permission. They are defined as follows:

The information on these pages may be changed to reflect school policy and philosophy, and general school or course information and scheduling. For example, in the Support area, the teacher could include an e-mail address at which he or she could be contacted by a student for help. If the school had specific instructions about assignments, detailed instructions could be added to the Assessment area. Modifications to the front end may include addition of pages and graphics, and rewriting pages. Be aware that in order to pass authorization this course has been carefully scrutinized to meet the provincial Recognizing Diversity and Promoting Respect standards as administered by the Learning and Teaching Resources Branch of Alberta Learning.

END USER LICENSING AGREEMENT FOR ELECTRONIC RESOURCES

NOTICE TO USER: BY USING THE RESOURCES INCLUDED WITH THIS LICENSING AGREEMENT, YOU ACCEPT ALL OF THE TERMS AND CONDITIONS HEREIN. If you do not agree with the terms and conditions of this Licensing Agreement, terminate use of the resources and remove all of the associated files from your system.

In return for acquiring a licence to use these electronic resources, you agree to the following terms and conditions.

  1. Scope of Use

    The resources are licensed, not sold, to you by the Crown in Right of Alberta for use on single workstations and/or on a computer network in one school jurisdiction. A "computer network" is any combination of two or more terminals that are electronically linked and capable of sharing the use of a single electronic product.

    To "use" the product is defined by the included files being loaded in either temporary (e.g., RAM) or permanent (e.g., hard disk, CD-ROM) memory of a computer.

    The Licensee may reproduce the electronic resource for unlimited use within the school jurisdiction. As an express condition of this allowance, you must reproduce with any such copy the Copyright Statement and any other proprietary notices that were on the original electronic resource supplied by the Crown in Right of Alberta.

  2. Restrictions

    You may not decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code for the electronic resource, unless you are permitted to do so by the terms of the Copyright Statement. You may not remove or obscure copyright or trademark notices. You are not permitted to rent, lease, sublicense, or loan the product. See the Copyright Statement for more information.

  3. Assignment

    The rights under this Licensing Agreement are non-exclusive and non-transferable. This Licensing Agreement does not grant you any right (whether by license, by ownership, or otherwise) in or to intellectual property with respect to the electronic resource.

  4. Term

    This Licensing Agreement is effective until terminated. The Crown in Right of Alberta may terminate this Licensing Agreement without notice if you breach any of its terms and conditions. Upon termination of this Licensing Agreement, you shall destroy all copies of the product and any related documentation.

  5. Product Updates

    The Crown in Right of Alberta may, from time to time and at its own discretion, provide you with updates to the electronic resource. The Crown in Right of Alberta reserves the right to provide these updates for a fee. You may refuse to accept the updates. By accepting an update, you agree to destroy all prior copies and versions of the electronic resource. Only then will the license granted to you by this Licensing Agreement transfer to the updated product.

  6. Warranty

    You hereby acknowledge that you are solely responsible for selecting the electronic resource and that the electronic resource may not satisfy all your requirements or be free from defects. The Crown in Right of Alberta specifically does not warrant that the electronic resource will operate uninterrupted or error free. You therefore agree to license the electronic resource "AS IS."

    THE CROWN IN RIGHT OF ALBERTA MAKES NO WARRANTIES, EXPRESS, IMPLIED, ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, OR STATUTORY, AS TO ANY MATTER WHATSOEVER. IN PARTICULAR, ANY AND ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS ARE EXPRESSLY EXCLUDED.

  7. Limit of Liability

    IN NO EVENT WILL THE CROWN IN RIGHT OF ALBERTA BE LIABLE TO YOU FOR ANY CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, OR FOR ANY CLAIM BY ANY PARTY, EVEN IF A REPRESENTATIVE OF THE CROWN IN RIGHT OF ALBERTA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  8. Governing Law

    In the event of conflicts, this Licensing Agreement shall be governed by the laws in force in the Province of Alberta.

  9. Entire Agreement

    YOU ACKNOWLEDGE THAT YOU HAVE READ THIS LICENSING AGREEMENT AND UNDERSTAND IT AND THAT IT IS THE COMPLETE AND EXCLUSIVE STATEMENT OF YOUR AGREEMENT WITH THE CROWN IN RIGHT OF ALBERTA AND SUPERSEDES ANY PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN THE CROWN IN RIGHT OF ALBERTA AND YOU RELATING TO THE SUBJECT MATTER OF THIS LICENSING AGREEMENT. YOU ALSO ACKNOWLEDGE THAT YOUR OBLIGATIONS UNDER THIS LICENSING AGREEMENT SHALL INURE TO THE BENEFIT OF YOUR LICENSORS, WHOSE RIGHTS ARE LICENSED UNDER THIS LICENSING AGREEMENT. NO VARIATION OF THE TERMS OF THIS LICENSING AGREEMENT SHALL BE ENFORCEABLE AGAINST THE CROWN IN RIGHT OF ALBERTA, UNLESS THE CROWN IN RIGHT OF ALBERTA GIVES ITS EXPRESS CONSENT IN WRITING SIGNED BY AN OFFICER OF THE CROWN IN RIGHT OF ALBERTA.
